Accessory Dwelling Units

NEW LAW:

Have you heard about the new Massachusetts law that went into effect on February 2, 2025 regarding Accessory Dwelling Units, often referred to as “ADUs” or “in-law apartments".  The new law permits ADUs by-right in single-family zoning districts statewide. This change stems from the Affordable Homes Act, signed into law by Governor Maura Healey on August 6, 2024.

KEY PROVISIONS OF THE ADU LAW:

  • By-Right Approval: Homeowners can now build an ADU without obtaining special permits or variances, simplifying the approval process.

  • Size Limitations: An ADU must be no larger than 900 square feet or half the gross floor area of the primary residence, whichever is smaller.

  • Separate Entrance: Each ADU must have its own entrance, either directly from the outside or through a shared entry hall, in compliance with state building codes.

  • Local Regulations: Municipalities may impose reasonable restrictions, such as site plan reviews, dimensional setbacks, and rules regarding short-term rentals. However, they cannot enforce owner-occupancy requirements or unreasonably restrict the creation or rental of ADUs.

COMMON REASON HOMEOWNERS CHOOSE ADUs:

  • Age in place.

  • Downsize from existing home.

  • Provide housing and/or space for family or friends to visit.

  • Young adult or recent college graduate.

  • Generate extra income with rental unit.

ADUs Classification:

INTERNAL

  • Unit that is inside the main building; small addition.

  • Entry is typically located off a shared entry hall.

SMALLER LOTS - NO DRIVEWAY

  • Split your unit.

  • Convert attic.

  • Convert basement.

  • Add new floor.

  • Addition towards rear yard.

ATTACHED

  • Building that is adjacent to main structure.

  • Typically with its own entrance.

MEDIUM LOTS -

  • Adapt your garage.

  • Addition towards rear yard.

  • Attach ADU on side.

  • Attached ADU on corner lot.

DETACHED

  • Building that is on its own.

  • Has its own entrance.

  • Converted detached Garage.

LARGER LOTS

  • Attached ADU in front yard.

  • Build small addition in backyard.

  • Build large addition in backyard.​​
